Fire Pits - Open Burning

Belmont is 1 of 22 communities in Massachusetts where open burning is not allowed.  This is due to the density of the population and the close proximity of buildings.  The Department of Environmental Protection (DEP) and the Belmont Fire Department limit open burning for safety reasons and public health.  Although it can be perceived as confusing, attached is the specific law on open burning.  The definition of open burning in the law is often misunderstood but applies to anything with an open flame.

Limits on open burning do not apply to outdoor cooking appliances which are defined as grills powered by liquid propane, charcoal, or electricity.  Outdoor fire pits, chimeneas, outdoor fireplaces, and other appliances designed with the primary purpose of heating are not allowed because they may present a hazard in this densely populated community.  The primary purpose of these items is not cooking, therefore they are not allowed in Belmont.

Although out of our control, we realize that these items are often sold in box stores, hardware stores, and online with no disclaimer.  Unfortunately, they are illegal and cannot be used regardless of whether or not they can be purchased.
