1.      CALL TO ORDER

2.      JOINT PUBLIC HEARING:

1.      CASE NO. 06-09 – FOUR SPECIAL PERMITS and SITE PLAN REVIEW  
        495-501 Common Street, Jenkins-Starr, LLC, Chris Starr, representative

The applicant seeks FOUR (4) SPECIAL PERMITS and TWO (2) DESIGN AND SITE PLAN REVIEWS to CONSTRUCT A THREE (3) STORY, 22,423 +/-SQUARE FOOT RETAIL/OFFICE BUILDING (square footage includes use of the cellar as commercial tenant space) in a Local Business I Zoning District.  This application requires the following –

FOUR (4) SPECIAL PERMITS –
        MAINTAIN THE EXISTING FRONT SETBACK – allowed 5’-0”; existing and               proposed 2.5’ on the first and          second floors (the third story will comply),
        INCREASE HEIGHT AND NUMBER OF STORIES – Section 4.4 allows a                    three-story and 32’-0” building by      Special Permit (proposed 3 stories and 32’)
                5,849 SQ. FT. OF RETAIL SPACE – Section 3.3 allows retail, sales and service                    uses greater than 5,000 sq. ft. by Special Permit, and
16,574 SQUARE FEET OF OFFICE SPACE - Section 3.3 allows office use greater than 5,000 sq. ft. by Special Permit,

AND DESIGN AND SITE PLAN REVIEW -  
        22,423 SQ. FT. COMMERCIAL BUILDING Section 7.3.2 a) requires Design and       Site Plan Review for new        structures greater than 2,500 sq. ft., and
        REDUCE PARKING REQUIREMENTS – Section 7.3.2 a) allows parking                   requirements to be reduced through      Design and Site Plan Review.
                DESIGN AND SITE PLAN REVIEW and TWO SPECIAL PERMITS under                       Sections 1.5.3 (alter a nonconforming structure) and 3.3 (proposed use) FOR A ROOF MOUNTED WIRELESS TELECOMMUNICATIONS FACILITY (four panel antennas and equipment cabinet) in an Apartment  House Zoning District.

The applicant seeks A VARIANCE FROM THE SIDE YARD SETBACK (allowed – 10’-0”; existing and proposed – 7.5’) in order TO CONSTRUCT AN ADDITION CONNECTING THE GARAGE WITH THE HOUSE (the detached garage is allowed a 5’-0” setback; however, by connecting the garage and house, the garage becomes part of the house and therefore subject to the 10’-0” side yard setback) in a GENERAL RESIDENCE ZONING DISTRICT.
